To be eligible to be a candidate for, or elected or appointed as, a Director, a person must:
(1) be a United States citizen;
(2) be 18 years of age or older on the first day of the term to be filled at the election or on the date of appointment, as applicable;
(3) have not been determined by a final judgment of a court exercising probate jurisdiction to be:
(A) totally mentally incapacitated; or
(B) partially mentally incapacitated without the right to vote;
(4) have not been finally convicted of a felony from which the person has not been pardoned or otherwise released from the resulting disabilities;
(5) be a resident citizen of the State of Texas, and either own land subject to taxation in the District or be a qualified voter within the District.
In addition, Section 49.052 of the Texas Water Code provides for certain disqualifications for directors. Those include persons related to a developer of property in the district, any other member of the board, or the manager, engineer, attorney or other person providing professional services to the district. Also, a director cannot be an employee of any developer of property in the district or any director, manager, engineer, attorney or other person providing professional services to the district or a developer of property in the district in connection with the district or property located in the district. A director also cannot be a developer of property in the district or serve as attorney, consultant, engineer, manager, architect or in some other professional capacity for the district or a developer of property in the district in connection with the district or property located in the district. A director is also disqualified if he or she is a party to a contract with or along with the district except for the purchase of public services furnished by the district to the public generally.
Finally, a director is disqualified if he or she is a party to a contract with or along with a developer of property in the district relating to the district or to property within the district, other than a contract limited solely to the purpose of purchasing or conveying real property in the district for the purpose of either establishing a permanent residence, establishing a commercial business within the district, or qualifying as a director.
